THE DECEASED WAS OPERATING A FRONT END LOADER MOVING COAL FROM A STACKER CONVEYER BELT WHEN A PORTION OF HIGHWALL FAILED AND STRUCK THE LOADER. ONLY A FEW SECONDS OF WARNING WAS GIVEN PRIOR TO THE FAILURE. THE PORTION OF HIGHWALL THAT FELL MEASURED APPROX 160 FT LONG BY UP TO 60 FT HIGH AND THE THICKNESS RANGED FROM FEATHEREDGED TO 10 FT.

Employee was climbing up onto a Mack rollback, when he slipped and fell into a low block wall, striking his side and back. Employee fractured L2 and L3. Employee was released from hospital with a back brace.

Dozer was pushing mateiral down a slope for reclamation. When he ran over a rock causing dozer to loose traction and slide sideways. Dozer then turned over.

Employee was tramming an excavator up a hill and was turning onto a road when the cat slid down the hill and the excavator turned onto it's side. Causing the employee to hit his right shoulder on the bars across the inside of the window.

On Sept 13, 2004 due to an occupational illness as substantiated by medical records and reports, ee became unable to work because of the ailments described in the medical reports. This was not duw to a single event at the mine, but repeated trauma over an extended period of time.

Employee was climbing down off dozer when he slipped and fell aprox. 6' to the ground hurting left shoulder and neck.

Employee was traming a 690 drill up a bench road when he noticed the machine loosing power. He looked in his right side mirror and saw flames coming out of the right engine compartment. He shut down the machine and exited it. Employee obtained the machines fire extingushers and used them on the fire. The fire continued to grow engulfing the machine.

Employee was operating an articulating rock truck. A rock had fallen off of the truck. When employee was backing up to turn truck he ran over rock causing a jarring motion in cab. Employee experienced pain in left shoulder. Employee continued to work until 11/5/2004 when he was removed from work by his doctor.

Employee was working on the pad of the Highwall miner. A car was placed on the pad and the employee and another pad man coupled up the cat heads on the car. The employee went back to pull the slack back into the tray resulting in pain in the lower back.

EE WAS OPERATING A CAT D9L DOZER RECLAIMING THE OUTSLOPE ON THE MTR MINE. HE WAS PUSHING DIRT & ROCK UP THE SLOPE AND AS HE BACKED DOWN THE SLOPE HE RAN OVER SOME ROCKS. SHORTLY THEREAFTER HE STARTED EXPERIENCING PAIN IN HIS LOWER BACK, MOST LIKELY DUE TO REPEATED TRAUMA.
