Employee now hired legal representation and Third Party Gallager Bassett advised new claim to be opened due to ch enge in legal status. Our first knowledge was on 05/02/11. Thus this filing. MSHA Notified by phone of this and advised this statement be entered.

Employee was assisting in the replacement of the diaphram toggle assembly in the jaw crusher. He had cleaned the crank case with brakeleen before installing the toggle assembly. The employee had a cigarette in his left hand when he turned to pick up a rag. The cigarette ignited the fumes.
